The developer`s removal of an app from the App Store is allowed at any time using tools on the iTunes Connect website. In general, deletion prevents only other downloads from the app, but does not remove previously downloaded copies of a user`s device. Apple reserves the right to remotely remove such previously downloaded applications, if, among other things, a developer does not have the right to enter into the license agreement or distribute the program, if it contains a violation of third-party intellectual property or obscene or offensive material, or if the developer attempts to claim a right against Apple , except in accordance with the dispute resolution procedures described below. In any case, deleting an app does not remove the developer`s obligations in the license agreement to Apple or existing end-users of the app. Apple has extremely extensive repair rights under the licensing agreement. When a developer accepts this agreement, it agrees to grant unlimited compensation for all claims related to the developed application, including, but not only to the developer`s breach of the license agreement, claims that the application violates the intellectual property rights of third parties, and even the authorized use of the app by Apple (including the use of excerpts from the app in advertising). Like Google, Apple allows developers to set the price of their paid app at their discretion (with package and subscription pricing options). And like Google, Apple takes a 30% commission on each sale. However, unlike Google, Apple collects and transfers sales and usage taxes directly to the relevant government authority for each sale (although the ultimate responsibility for these taxes is always the responsibility of the developer). Payments are made to developers, net of these amounts, within 45 days of the end of each month of sale. Under the licensing agreement, Apple also grants the developer a limited, non-exclusive, personal, revocable, non-sub-conceded and non-transferable license for the use of Apple software for application development and testing.
Apple does, however, reserve the right to limit the number of devices on which this software can be installed. If a developer wishes to terminate the license agreement, they can do so at any time and for any reason by announcing Apple 30 days after the written termination. The license agreement also requires developers to comply with certain confidentiality obligations that survive permanently.
